Stolmeier Law Fights For Medical Malpractice Victims

Medical malpractice results from a healthcare provider’s negligence. Medical malpractice occurs when a healthcare provider deviates from a standard of care that that is recognized in the medical community when treating a patient. This means that a healthcare provider’s standard of care must conform to the standard of care practiced by other doctors in the state they practice in. In other words, a healthcare provider must act reasonably when treating a patient.

A healthcare provider’s failure to act reasonably when treating a patient can rely on many different factors. These factors can include:

  • A patient’s age
  • A patient’s weight
  • A patient’s allergies
  • A patient’s pre-existing conditions
  • A patient’s own self-care
  • Reasonably expected complications from medical treatment

How Soon Does a Medical Malpractice Victim Have to File a Claim?

Like other negligence claims in Texas, a medical malpractice victim must file a claim no later than two years after a victim is injured or no later than two years after a victim discovers the injuries sustained from the medical malpractice. Medical malpractice claims can be discovered immediately such as when a healthcare provider negligently injures a patient during a procedure or surgery. However, a medical malpractice injury may only present itself over a period of time, such as when a healthcare provider negligently prescribes the wrong type of medication. It is vitally important to contact Stolmeier Law once you discover injuries sustained from medical malpractice. If a lawsuit is not filed within the two year time period, then your cause of action will be barred and you will not be able to recover any damages.
