What is Product Liability?

How a Claim Arises

A claim must arise from a product that was sold in the marketplace. A product liability claim used to require privity of contract. Privity of contract means there must be a relationship between the injured party and the manufacturer or supplier of the dangerous or defective product. Privity of contract can be created when the injured party was the purchaser of the dangerous or defective product. However, product liability law has changed so that product liability is no longer required for an injured party to recover. Now a party who could foreseeably be injured by the dangerous or defective product can file a claim for their injuries. For example, a child who is injured by a dangerous or defective oven purchased by his parent could file a claim against the toaster’s manufacturer, retailer, and anyone else in the chain of sale.
